Harmonique offers custom song creation, music production services, and digital content through the Website. Our services are designed for personal, non-commercial use and include the delivery of personalized audio recordings (“Works”).
To use our services, you must be:

Capable of entering into a legally binding agreement.
If you are using the services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
Upon purchase, you will be prompted to submit notes, inspirations, or instructions to guide the creation of your custom song. Our creative team will use this input to produce the final product.
Most songs are delivered within [3–5] business days unless otherwise stated. Harmonique makes no guarantees regarding delivery times but will endeavor to meet communicated expectations.
Prices are listed in USD and are subject to change without notice. Payment is required in full at the time of order. All payments are processed securely via third-party processors. Harmonique does not store your credit card information.
All custom songs and music productions are licensed—not sold—to the Customer under the following terms:
Harmonique retains all rights, title, and interest in and to the Works, including all copyrights and publishing rights.
The Works are not works made for hire and no ownership transfers to the Customer.
Harmonique reserves the right to register the Works with music rights organizations such as ASCAP, BMI, SESAC, etc.
Harmonique grants the Customer a perpetual, non-exclusive, non-transferable license to use the Works for personal, non-commercial purposes only.
This includes personal listening, private sharing, use in family events, and non-commercial social media use (with appropriate credit to Harmonique).
No commercial exploitation of the Works is permitted without prior written consent from Harmonique. This includes:
Monetized YouTube or Spotify releases
Use in advertising, brand promotions, or commercial videos
Distribution via streaming platforms or digital sales
Sync usage in films, shows, or podcasts
To request commercial rights, you must contact Harmonique in writing. Harmonique reserves the right to approve or deny any such request at its sole discretion.
All content on this Website—including text, graphics, logos, music samples, and software—is the intellectual property of Harmonique or its licensors and is protected under applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, display, or create derivative works from any part of the Website or the Works without express permission from Harmonique.
You retain ownership of any notes, messages, or input you provide to guide your custom song (“User Content”). By submitting User Content, you grant Harmonique a worldwide, royalty-free, irrevocable license to use, reproduce, modify, and incorporate it into the final Work.
You warrant that you have the necessary rights to submit User Content and that it does not infringe upon any third-party rights.
Because our products are customized and creative in nature, all sales are final. Refunds or revisions are only offered at Harmonique’s sole discretion in the case of non-delivery or failure to substantially meet the brief provided.
You agree not to:
Use the Website for any unlawful purpose
Attempt to access unauthorized parts of the Website
Interfere with the Website’s operation or security
Use automated means to scrape or access the Website
Violation of these terms may result in termination of your access without notice.
